ARTICLE 2 – DEFINITIONS
"We", "us", "our" refers to Maison Amévie.
"You", "your" refers to the customer placing an order via our website.
"Website" refers to https://maisonamevie.com.
"Agreement" means the purchase agreement concluded between you and us.
"Goods" means the clothing and accessories offered for sale on our website.
ARTICLE 3 – APPLICABILITY
These Terms of Service apply to every offer we make and every agreement concluded between us and you via the website. Before placing an order, you are able to read and save these Terms. We recommend you do so.
These Terms may be updated from time to time. The version in force at the time of your order applies to your purchase.
ARTICLE 4 – THE OFFER
All offers on our website are without obligation and subject to availability. We reserve the right to correct any obvious errors in pricing or description. Images are illustrative; slight differences in colour between screen and product may occur.
ARTICLE 5 – FORMATION OF THE AGREEMENT
An agreement is formed at the moment you place an order and we confirm it by e-mail. We reserve the right to refuse orders for legitimate reasons, in which case we will notify you promptly and refund any payment made.
ARTICLE 6 – PRICES
All prices are in euros and include VAT where applicable. We reserve the right to adjust prices, but the price applicable at the time of your order applies to your purchase. Obvious pricing errors do not bind us.
ARTICLE 7 – PAYMENT
Payment is made via the payment methods offered in our checkout at the time of your purchase.
ARTICLE 8 – DELIVERY
We aim to deliver within the timeframe stated on our website. The applicable delivery times and conditions are set out in our Shipping Policy at https://maisonamevie.com/policies/shipping-policy. In any case, we will deliver no later than 30 days after the order date unless otherwise agreed (in accordance with Article 7:19a of the Dutch Civil Code). If we are unable to meet that deadline, we will notify you promptly and you will be entitled to cancel the order free of charge.
We deliver worldwide. Maison Amévie remains the seller and bears full responsibility for delivery and product conformity, regardless of the fulfilment method used.
ARTICLE 9 – RIGHT OF WITHDRAWAL
You have the right to withdraw from your purchase within 14 days without giving any reason. The conditions, exceptions, return procedure, and model withdrawal form are set out in full in our Return & Refund Policy at https://maisonamevie.com/policies/refund-policy. That policy is the authoritative and leading document for all return matters.
ARTICLE 10 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to goods that are sealed for health or hygiene reasons and have been unsealed after delivery (Article 6:230p of the Dutch Civil Code). This exception applies only where the seal has actually been broken after delivery. Full details are in our Return & Refund Policy.
ARTICLE 11 – CONFORMITY AND LEGAL GUARANTEE
We are responsible for delivering goods that conform to the agreement. You are entitled to the statutory legal guarantee under Articles 7:17 and 7:21 of the Dutch Civil Code. This means that if a product is defective or does not match its description, you are entitled to repair, replacement, or — where that is not possible — a price reduction or refund. Nothing in these Terms limits or excludes your statutory consumer rights.
ARTICLE 12 – COMPLAINTS
If you have a complaint, please contact us at shop@maisonamevie.com. We will acknowledge receipt of your complaint within 7 days and provide a substantive response within 14 days. If we are unable to resolve your complaint, you may submit the dispute to the competent court under applicable law.
For EU consumers: information about out-of-court dispute resolution (ADR) bodies in your country is available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
ARTICLE 13 – LIABILITY
Our liability is limited to the extent permitted by applicable mandatory law. We are never liable for indirect or consequential loss. Nothing in this article limits or excludes liability arising from mandatory consumer protection law.
ARTICLE 14 – RETENTION OF TITLE
All goods remain our property until payment in full has been received.
ARTICLE 15 – APPLICABLE LAW AND JURISDICTION
These Terms are governed by Dutch law. Disputes will be submitted to the competent court under applicable law. This choice of law does not deprive consumers of the protection afforded by the mandatory provisions of the law of their country of habitual residence (Rome I Regulation, Article 6(2)).
EU minimum consumer rights — including the right of withdrawal — apply as a minimum standard to all customers, including those outside the EU.
ARTICLE 16 – LANGUAGE
These Terms are available in English and Dutch. In the event of any inconsistency between the two versions, the Dutch version prevails.

"Wij", "ons", "onze" verwijst naar Maison Amévie.

"Overeenkomst" betekent de koopovereenkomst die tussen u en ons tot stand komt.
"Producten" betekent de kleding en accessoires die wij op onze website aanbieden.
ARTIKEL 3 – TOEPASSELIJKHEID
Deze algemene voorwaarden zijn van toepassing op elk aanbod van ons en op elke via de website tot stand gekomen overeenkomst. Voordat u een bestelling plaatst, kunt u deze voorwaarden lezen en opslaan. Wij raden u aan dit te doen.
Deze voorwaarden kunnen van tijd tot tijd worden aangepast. De versie die geldt op het moment van uw bestelling is van toepassing op uw aankoop.
ARTIKEL 4 – HET AANBOD
Alle aanbiedingen op onze website zijn vrijblijvend en onder voorbehoud van beschikbaarheid. Wij behouden ons het recht voor kennelijke fouten in prijzen of omschrijvingen te corrigeren. Afbeeldingen zijn illustratief; geringe kleurverschillen tussen scherm en product zijn mogelijk.
ARTIKEL 5 – TOTSTANDKOMING VAN DE OVEREENKOMST
Een overeenkomst komt tot stand op het moment dat u een bestelling plaatst en wij deze per e-mail bevestigen. Wij behouden ons het recht voor bestellingen om gegronde redenen te weigeren, in welk geval wij u hiervan tijdig op de hoogte stellen en een eventuele betaling terugstorten.
ARTIKEL 6 – PRIJZEN
Alle prijzen zijn in euro's en zijn inclusief btw waar van toepassing. Wij behouden ons het recht voor prijzen te wijzigen, maar de prijs die geldt op het moment van uw bestelling is van toepassing. Kennelijke prijsfouten binden ons niet.
ARTIKEL 7 – BETALING
Betaling geschiedt via de betaalmethoden die wij in onze checkout aanbieden op het moment van uw aankoop.
ARTIKEL 8 – LEVERING
Wij streven ernaar te leveren binnen de op onze website vermelde termijn. De toepasselijke levertijden en voorwaarden staan vermeld in ons Verzendbeleid op https://maisonamevie.com/policies/shipping-policy. In ieder geval leveren wij uiterlijk binnen 30 dagen na de besteldatum, tenzij anders overeengekomen (artikel 7:19a BW). Indien wij deze termijn niet kunnen halen, stellen wij u hiervan tijdig op de hoogte en heeft u het recht de bestelling kosteloos te annuleren.
Wij leveren wereldwijd. Maison Amévie blijft de verkoper en draagt volledige verantwoordelijkheid voor levering en productconformiteit, ongeacht de wijze van fulfilment.
ARTIKEL 9 – HERROEPINGSRECHT
U heeft het recht uw aankoop binnen 14 dagen te herroepen, zonder opgave van reden. De voorwaarden, uitzonderingen, retourprocedure en het modelformulier voor herroeping staan volledig beschreven in ons Retour- en Restitutiebeleid op https://maisonamevie.com/policies/refund-policy. Dat beleid is het gezaghebbende en leidende document voor alle retouraangelegenheden.
ARTIKEL 10 – UITZONDERINGEN OP HET HERROEPINGSRECHT
Het herroepingsrecht geldt niet voor goederen die omwille van gezondheids- of hygiëneredenen zijn verzegeld en waarvan de verzegeling na levering is verbroken (artikel 6:230p BW). Deze uitzondering geldt uitsluitend indien de verzegeling daadwerkelijk na levering is verbroken. Zie voor de volledige details ons Retour- en Restitutiebeleid.
ARTIKEL 11 – CONFORMITEIT EN WETTELIJKE GARANTIE
Wij zijn verantwoordelijk voor de levering van producten die beantwoorden aan de overeenkomst. U heeft recht op de wettelijke garantie op grond van de artikelen 7:17 en 7:21 BW. Dit betekent dat u bij een gebrek of afwijking van de omschrijving recht heeft op herstel, vervanging of — waar dat niet mogelijk is — een prijsvermindering of terugbetaling. Niets in deze voorwaarden beperkt of sluit uw wettelijke consumentenrechten uit.
ARTIKEL 12 – KLACHTEN
Bij klachten kunt u contact opnemen via shop@maisonamevie.com. Wij bevestigen ontvangst van uw klacht binnen 7 dagen en geven een inhoudelijke reactie binnen 14 dagen. Kunt u er samen met ons niet uitkomen, dan kunt u het geschil voorleggen aan de bevoegde rechter.
Voor consumenten in de EU: informatie over buitengerechtelijke geschilbeslechting (ADR) in uw land is beschikbaar via https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
ARTIKEL 13 – AANSPRAKELIJKHEID
Onze aansprakelijkheid is beperkt voor zover de toepasselijke wetgeving dat toestaat. Wij zijn nimmer aansprakelijk voor indirecte of gevolgschade. Niets in dit artikel beperkt of sluit aansprakelijkheid uit die voortvloeit uit dwingend consumentenrecht.
ARTIKEL 14 – EIGENDOMSVOORBEHOUD
Alle producten blijven ons eigendom totdat de volledige betaling is ontvangen.
ARTIKEL 15 – TOEPASSELIJK RECHT EN GESCHILLEN
Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter. Deze rechtskeuze ontneemt consumenten niet de bescherming die zij ontlenen aan de dwingende bepalingen van het recht van hun gewone verblijfplaats (Rome I-Verordening, artikel 6 lid 2).
De minimumrechten van EU-consumenten — waaronder het herroepingsrecht — gelden als minimumstandaard voor alle klanten, ook buiten de EU.
ARTIKEL 16 – TAALVERSIES
Deze voorwaarden zijn beschikbaar in het Engels en het Nederlands. Bij tegenstrijdigheid tussen beide versies prevaleert de Nederlandse versie.
